Terms

The agreement between you and us. Written to be read rather than survived, and short for the same reason the product is.

Who you are dealing with

These terms are an agreement with Latest Note — United Kingdom. "We" and "us" mean Latest Note. "You" means the person or organisation using an account.

Using the service means accepting these terms and the privacy policy.

The service

Latest Note lets you publish updates about your product and collect ideas and votes from the people who use it, through a widget on your site and a public page.

Each site has one owner: the person whose plan it runs on. Everyone on a site's team can publish updates, manage ideas and invite others. Only the owner can delete the site, remove other people from it, change its signing secret, connect its own domain or hand ownership to someone else on the team.

It is provided as it is. We do not promise it will always be available, and there is no service level agreement. It is built and maintained by one person; there will be bugs, and when you report them they will be fixed where they can be.

If Latest Note is ever going to close, account holders will be emailed at least 30 days beforehand, with a way to take their posts and ideas with them.

What it costs

There are three plans. Every plan includes unlimited team members, and unlimited votes and ideas from the people using your board — you never pay for headcount.

  • Note — free. One site, up to 4 published updates per calendar month (counted in UTC), and a small "Powered by Latest Note" line on your widget and public page.
  • Beacon — US$9.99 a month. One site, publish as often as you like, no Latest Note branding, and vote-trend analytics.
  • Broadcast — US$19.99 a month. Everything in Beacon, as many sites as you like, your public page on your own domain, and priority email support: your emails are answered before anyone else's. There is no guaranteed response time.

Paying

Beacon and Broadcast are monthly subscriptions, paid in advance by card on pages hosted by Stripe. Where VAT or sales tax is charged, it is shown on that payment page before you pay. The subscription renews each month until you cancel it.

On your card or bank statement it appears as SHIPPEDIN12MONTHS, not as Latest Note. That is the business behind both. It is said here plainly so an unfamiliar line on a statement is never mistaken for a payment you did not make.

We will tell account holders at least 30 days before any price rise, and it only applies from your next renewal after that. Nobody is ever charged without agreeing to it first.

Changing plan

You can move between Beacon and Broadcast, or back to Note, from Stripe's billing page — the link is on your Billing screen and in every receipt.

Moving to a smaller plan never deletes anything. Your sites, posts, ideas and votes all stay, and your public pages stay up. You simply work within the smaller plan from then on: if you own more sites than it includes you can't create another until you upgrade or delete one; the monthly update limit and the branding line return on Note; and a connected domain pauses, with your public page served from latestnote.com instead, until you are back on Broadcast.

Cancelling and refunds

Cancel whenever you like from Stripe's billing page. No reason needed. Your plan carries on until the end of the month you have paid for, then your account moves to Note.

Deleting your account cancels any subscription straight away, so you are never charged again for an account that no longer exists. The rest of that month is not refunded, except under the 14-day promise below.

If you are unhappy within 14 days of any payment, email us and we will refund it in full. If something has gone wrong at our end after that, tell us and we will put it right.

If you are a consumer rather than a business, nothing here affects your statutory rights.

Your content, and your responsibility for it

The posts you publish are yours, and so is the responsibility for them. The ideas people add to your board are shown publicly on your site and your public page, and moderating them is up to you: you can change their status, merge duplicates or delete them.

If you connect your own domain, you must own it or have its owner's permission. We may disconnect a domain that is being used to mislead people.

You give us permission to store, display and deliver your content only so far as needed to run the service.

What you must not do with it

Do not use Latest Note to:

  • publish anything unlawful, or anything that infringes somebody else's rights
  • collect personal information from the people using your board beyond what the product itself does
  • harass, deceive or impersonate anybody
  • overload, break or get around the limits of the widget, the public pages or the API, or cast votes automatically
  • resell the service as though it were your own product

When we step in

We may remove content, or suspend or close an account, that breaks these terms. We will tell you why, unless the law prevents us or the content is plainly abusive.

Ending it

A site's owner can delete it at any time from its settings, and you can delete your whole account from your account page. What deleting removes, and what happens to a paid subscription, is described in the privacy policy and above.

If something goes wrong

We will do our best, but we are one person and a small piece of software. To the extent the law allows, we are not liable for indirect or consequential losses — lost profits, lost business or lost data — and our total liability to you in any twelve months is limited to what you paid us in that time.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Changes to these terms

We may update these terms. For anything that materially affects you, we will email account holders at least 30 days beforehand. Carrying on using the service after that means accepting the new version.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction — except that if you are a consumer elsewhere in the UK, you may bring proceedings where you live.
